The claims by the crack legal team hired by McClatchy are really embellished... they accuse Bill of "reproducing complete Miami Herald articles." That's partially true, since Bill admits to posting some old articles from Herald archives. But he doesn't cut and paste current articles. And, they accuse him of printing "full size photos" from the Herald. Not true. (FYI, the photos the Herald is worried about are posted here.)

Two pages, two pictures, four “boobs!”

...Sorry “Sweetie,” proud to be a breeder...
This, which has absolutely nothing to do with the topic, says something about you that you stress a little too often and a little too strenuously. Get help for whatever is worrying you.

I would not expect the second correspondence from the lawyers to be nearly as..friendly..
It is never a good idea to post a complete article, even in the comments section. FreeRepublic.com was sued by the NYT. Now to post there you have to agree to abide by their rules, and there is this:
"Posting user agrees to indemnify Free Republic for any copyright claim on original works."

Indeed not. And these bloggers will then find their homeowners insurance does not cover their for profit publishing activities and find themselves and their family's assets completely at risk.
